The Truth About Buying A Property Under Power of Sale

 

Is it really a bargain?

Given all the safeguards built into the normal purchase and sale agreement buying a power of sale is not for the faint of heart. They are a true test for an old axiom "caveat emptor" let the "buyer beware". In these cases what you see is not always what you get if you get anything at all.

Real estate buyers have somehow been conditioned to think that buying a property listed under a power of sale arrangement represents an opportunity for a real deal.
 
I've noticed some REALTORS® capitalizing on this belief by advertising special websites to find out about these listings and, I've seen REALTORS® advertising the power of sale status right in their property ads for a listing.  The truth is, it does make the phone ring.  But should it?

While there are different remedies a lender can access when there is default on a mortgage loan, the most common one by far in Canada is where lenders exercise their right - that is their power, to sell a property when default has occurred.  After following a strict prescribed set of rules about notice to the home owner and other interested parties, lenders can use their power to sell the property.  Note, they do not take ownership.

What many buyers don't know is that the homeowner who defaulted is still responsible for any shortfall in the balance of the debt owing.  That's right:  A lender who sells a property for less than the outstanding debt, may sue the owner of the property for the shortfall.
And here's the rub:  The owner of the property may sue the lender if they can prove that the sale was made for less than the value of the property.

So, the lender has an obligation to sell the property for fair market value or, they risk being sued by the homeowner.  Unlike the homeowner, the lender does not have emotional discretion or motivation.  The lender will have had property appraisals done and this will become the guideline for them as it is justifiable in a court of law.  If a property is not then sold for that amount or more in a reasonable period of time, they may begin to slowly reduce the price in small increments until a sale occurs.

For a buyer, this means that while they may feel they got a "deal," chances of this are about the same, or sometimes worse than with an owner sold property.

Beyond price, there are other potential risks or downsides buyers should be aware of.  Almost all lenders have their own schedules of terms that must be included in any Agreement of Purchase and Sale.  For instance, in no cases will they give any warranties with respect to the condition of the property.  Heck, they have usually not even seen it!  They can also not include any chattels such as appliances or window coverings that may be present in the property as they have no claim on the ownership of those.  They may be there on the closing date or maybe not.  The schedule usually also includes something a bit scary for buyers and that is, a right of redemption by the owner.  This means that at any time, the owner can bring the mortgage back into good standing in which case the sale is called off.  In reality, this very rarely happens as the home owner would have mounting legal costs associated with the power of sale proceedings that they would also need to pay.

In any case, I would always recommend that potential buyers of these properties should speak with their lawyer about the contract.  No one else, including a REALTOR®, is qualified to give you legal advice.

There are things that you can do to reduce your risk including have a home inspection, making enquiries with the municipality about outstanding work orders, zoning or pending special assessments, checking health unit records for information about wells and septic systems if it is a rural property, performing a search of title for surveys or other pertinent documents and so on.  Your REALTOR® and lawyer should be your partner in this fact-finding mission.

Why Does Grandma Wear Funky Glasses

Yes Grandma Wears Funky Glasses ... not to be cool or to be told they look like Elton John's but because Grandma has a very rare eye condition, called Benign Essential Blepharospasm (BEB), Hopefully this post will help raise awareness of this disorder which in turn will help in raising funds for research into the cause to help find a cure.

Currently the most common form of treatment is periodic injections of botulinum toxin.

This movement disorder of the eyelids affects an estimated 5 out of every 100000 people, mostly women, with the average age of onset being 56. 

 

"The term blepharospasm ['blef-a-ro-spaz-m] can be applied to a forced, sustained, and involuntary closure of the eyelids. It stems from a number of causes, beginning with dry eyes, and, may progress to a state where the person is "legally blind". The blepharospasm referred to here is officially called Benign Essential Blepharospasm (BEB). Ottawa Tulip Festival

Ottawa is Blooming and and the tulips are approcahing their prime viewing time. You still have a chance to enjoy the Canadian Tulip Festival In Ottawa. This annual Festival runs for 18 days, from May 1 to May 18.

"The Tulip Festival showcases our national capital to hundreds of thousands of visitors, celebrating our international friendships and reaching out to diverse cultures in a way that reflects core Canadian values."

The founding idea of the Festival is international friendship, which is expressed by supporting international outreach in very tangible ways. Last year the Festival was able to contribute to War Child Canada, which helps children displaced by conflict. This year Festival goers are being urged to to help support Soles4Souls to send much-needed footwear to impoverished children and families overseas.

For 2009, the Festival has expanded with more activity and locations along the Tulip Route, at Festival Plaza outside City Hall and at Lansdowne Park by Queen Elizabeth Drive in addition to the traditional activity sites at Major's Hill Park and at Commissioner's Park, and Dows Lake.

"The Tulip Festival is a welcome event each spring. Festival ‘09 will be an optimistic event at a somewhat pessimistic time."

The International Pavilion, which last year drew record crowds, expands this year to 25 participating embassies and local cultural groups and will be located at Lansdowne Park. Visitors will be able to enjoy a variety of international entertainment daily on the Friendship Stage, taste traditional international cuisine, dip into the history of participating countries, explore traditions, shop for souvenirs and discover exotic travel destinations. The International Pavilion, free to the public, runs for all 18 days of the Festival at Lansdowne Park.

Celebridée, the Festival's celebration of ideas, will again be staged in the beautiful Mirror Tent from Belgium, which was a new and very popular venue last year, will this year be located at Festival Plaza in front of City Hall.

In addition to Celebridée programming, the Tulip Festival Mirror Tent will host

musical performances by Ian Tyson, Kleztory, Lynn Miles, Meredith Luce, Kellylee Evans and two children's concerts with Fred Penner.

the spectacular Nanjing Acrobatic Troupe for the duration of the Festival with a total of 23 performances. One of China's top performing groups, the Troupe will present a unique opportunity for North American audiences to enjoy the very best in Chinese acrobatic and circus performances.

Montreal's critically acclaimed Seven Fingers, an ensemble comprised of Quebec's top circus performers in their brilliant and profound production, La Vie.

Major's Hill Park will now host an all-new event, the Circus School and Vintage Carnival.

Presented in association with Carnivale Lune Bleue, the Circus School will run for 18 days and give young people and adults alike the opportunity to learn circus skills such as juggling, stilt walking, trapeze techniques, trampoline skills and much more.

Free live performances will animate the site every 30 minutes. Vintage rides including a Ferris wheel from 1917 will augment all of the carnival activity.

Major's Hill Park will also feature a Green Tulip Showcase, part of the Festival's new Green Tulip Initiative. The Showcase is a display area that presents green alternatives, both big and small, from different energy sources to simple choices individuals can make in their daily lives.

Step In Thyme Antiques and Artisans Show and Sale

In this house the author of "Anne of Green Gables" lived for fifteen years, and here wrote eleven of her twenty-two novels, including "Anne of the Island" (1915) and "Anne's House of Dreams" (1916). Born in 1874 at Clifton, Prince Edward Island, she was educated at Charlottetown and Halifax. From 1898 to 1911, she lived at Cavendish, P.E.I., and there began her career as a novelist. In 1911 she married the Rev. Ewan Macdonald, a Presbyterian minister, and came with him to Leaskdale. They moved in 1926 to Norval, and nine years later to Toronto, where she died in 1942. Mrs. Macdonald was awarded the O.B.E. by King George V in 1935

Flutterbys

One of the joys of living in the country, surrounded by gardens, is the number of butterflies that flutter by the windows.

Unfortunately it is still a little early to enjoy all the butterflies that pay an annual visit to my gardens, so I thought I might get a head start by paying a visit to the Metro Toronto Zoo and the butterfly conservatory. Apparently many others must had the same thought, as the conservatory was packed. Peering between the heads or focusing between the jostles made getting good pictures very difficult . Here are a few that I did manage to take. Notice the cut oranges that are used to attract and feed the butterflies.

Just as the zoo attracts the butterflies with the oranges we attract customers with our web presence, our print advertising and a variety of other means.

While the orange attracts and offers nourishment to the butterflies our promotional messages only attract, we require listings to satisfy the Home Buyers that we attract. Those folks we attract who are wishing to sell their home also must be nourished by what we offer them. You want to know if we have more than one web site and do we Blog. Are our websites all about real estate or do we offer more?

Many find us by our visibility on the web so search engine ranking is also important to You when you want to sell your home. But above all, we satisfy your needs the most with the experience and knowledge gained over the years. However it is our ability to negotiate on behalf of our clients where many of us bloom, just yesterday after negotiating the sale of a property I was complemented on my negotiating skills by my client.

While it may be true there are some in our industry that just flutterby, like the butterfly they are here today and gone tomorrow, there are many who have made a real career of helping people find that perfect dream home.

Could You Do It?

I have three very precious grandchildren who are allergic to nuts especially peanuts. One is so allergic that if you eat a product that contains peanuts and breath near him he may have an allergic reaction so severe that he has to be hospitalized.

I have sat by his hospital bedside on several occasions as he lay there in anaphylactic shock, his breath so shallow that you could not tell if he was breathing, knowing that while he appeared to be peacefully sleeping in fact he was fighting for his life.

I have kept my home nut free since his diagnosis 3 years  ago, it is a challenge but in our case certainly worth the effort. I want to be able to have a safe haven for him to visit, they rarely visit other homes as the risk is just too great.

This week is National Food Allergy Awarness Week and the start a New Blog No Nuts For Me by Shawn (our son in law) about living with nut allergies. His first post talks about some of the steps they take to ensure a nut free environment for their three sons the restaurants they cannot enter and foods that have been know to cause deaths.

 

 

The following is from My Daughters Facebook pages and I have included it in it's entirety as she has some wonderful links that you may find very useful if you are dealing with food allergies.

 

"Could you do it? Could you be Allegen free for 24 hrs? This week is National Food Allergy Awareness Week. Anaphylaxis Canada is challenging everyone to take a 24hr period and be allergen free. Could you do it?

You would need to know where everything you put into your mouth came from. Was it made in Canada? Are the allergens listed on the label? Does it contain trace amount of allergens? Has it come into contact with any allergens and is cross-contaminated? Do you know and trust the person who made the food? Was it baked in a bakery? Did it come from the bulk section? Was it prepared in a grocery store?

Have you read the label 3 times? Once in the grocery store, once when you put the food away when you bring it home, and once when you are about to use it.

Could you do it?

Our family lives a completely peanut-free life. We have to. Our three children are allergic to peanuts, even trace amounts of peanuts. Our youngest is airborne allergic to peanuts. So if you have eaten a peanut/nut product and you are near him, he could react to you.

Being peanut/nut fee is a way of life. You can't cheat, like you might if you were on a diet. You can't "guess" that something is "safe". It is 3 precious lives we are dealing with. They are our children.

Dear Registrant,

Anaphylaxis Canada is pleased to announce that May 4th - 8th, 2009 has been declared as "National Food Allergy Awareness Week" by the Parliament of Canada. A motion moved by MP Cheryl Gallant received all party support in the House of Commons on April 28, 2009. The motion is also a result of efforts by MP Gerard Kennedy. We thank all parties for their support of this declaration.

This is the first year that we have had this designation made in Canada. To commemorate this week we have a number of initiatives planned to help increase awareness of managing food allergies and educating the community on the issues faced by those at risk for anaphylaxis.
